Terms of Use

Agreeing to these terms

Gable is transaction-management software for real estate agents and their clients, operated from Ontario, Canada. By creating an account or using the Gable website at getgable.ca or the Gable mobile apps, you agree to these terms. If you are using Gable on behalf of a brokerage, you confirm you are allowed to accept these terms for it.

If you do not agree, do not use Gable. You can stop at any time by deleting your account in Settings.

What Gable does

Gable organises live real estate transactions: deadlines, tasks, documents, comparable properties, client updates and reports. It is a tool for running deals you already have. It is not a brokerage, not a lead source, and not a party to any transaction you manage with it.

Everything Gable produces — reports, drafted messages, drafted social posts, suggested dates — is a draft for you to review. You decide what is sent, published, or acted on, and you remain responsible for it.

Your account

You need an account to use Gable, and accounts are for one person. Keep your sign-in details to yourself and tell us promptly if you think someone else has access.

You are responsible for what happens under your account, including anything your clients see through a portal you invite them to.

Professional obligations are yours

If you are a registered real estate professional, your regulator’s rules apply to everything you do with Gable — in Ontario that is RECO, and elsewhere the equivalent body. That includes advertising requirements, disclosure, record-keeping and how you communicate with clients.

Gable helps you keep records and drafts communications. It does not discharge any of those obligations for you, and it is not legal, financial or professional advice.

MLS and listing data

Gable displays listing data — including sold data — that comes from the MLS systems your board operates, through a licensed data provider. Your right to see and use that data comes from the data agreements you and your brokerage have signed with your board, not from Gable.

You agree to use that data only as those agreements permit: not to redistribute it, not to scrape or bulk-export it, and not to give access to anyone who is not entitled to it. If your board membership or data agreements end, your access to that data through Gable ends with them.

Comparable sales

Gable shows comparable sales and area statistics drawn from MLS® and portal data. That data is sometimes incomplete or out of date, and a comparable is not a valuation.

Gable does not produce an estimated value for a property. Nothing in the product is an appraisal or a formal opinion of value, and any pricing judgement you form from the comparables shown is your own professional one.

Connected accounts

Gable can connect to third-party services on your instruction — Google Calendar, Facebook and Instagram among them. When you connect one, you authorise Gable to act on your behalf within the permissions you grant, and you can revoke that at any time in Settings or with the provider directly.

Those services have their own terms, and you remain responsible for following them — including advertising rules on any platform where you promote a listing.

Acceptable use

You agree not to use Gable to:

  • break the law, or a professional or board rule that applies to you
  • send messages to people who have not agreed to hear from you
  • upload anything you do not have the right to upload
  • attempt to access another organisation’s data, or probe the service’s security
  • resell, sublicense, or copy the service or its underlying data

Subscriptions and payment

Paid subscriptions are billed in advance for the period you choose, in Canadian dollars, plus applicable taxes. Fees are charged to the payment method you provide until you cancel.

You can cancel at any time. Cancelling stops the next charge and leaves your access running to the end of the period you have already paid for. We do not refund unused time on a period already started, unless the law requires it. If prices change, we will tell you before the change applies to you.

Your content

The listings, documents, notes and photos you put into Gable stay yours. You give us only the permission needed to run the service for you: to store that content, display it to the people you share it with, back it up, and process it to produce the reports and drafts you have asked for.

The software itself, and the Gable name and design, remain ours.

Availability

We work to keep Gable running, but we do not promise it will be uninterrupted or error-free. Parts of it depend on services we do not control — MLS data feeds, email delivery, calendar and social platforms — and those can fail or change without notice.

Gable is not a system of record for anything you are legally required to retain. Keep your own copies of documents that matter.

Liability

Gable is provided as is, without warranties of any kind to the extent the law allows.

We are not liable for lost profits, lost transactions, or indirect or consequential losses. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

Ending your access

You can delete your account at any time in Settings. We may suspend or end access if these terms are broken, if a payment fails and stays unpaid, or if we are required to. Where it is reasonable to give notice first, we will.

What happens to your data afterwards is described in our Privacy Policy.

Changes to these terms

We may update these terms. If a change materially affects you, we will give notice before it takes effect — by email or in the app. Continuing to use Gable after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. The courts of Ontario have jurisdiction, without affecting any consumer-protection rights you have where you live.
